Terms of Service

1. Who we are and acceptance of the terms

Bulkio is a training and nutrition planning and tracking service. By signing up for or using any Bulkio service (the "App") you agree to be bound by these Terms of Service and by the Privacy Policy. If you do not agree with any of these conditions, you must not use the platform.

2. Your account

You must be at least 18 years old. You are responsible for the activity on your account and for keeping your credentials confidential; tell us if you think someone is accessing it without your permission.

3. Plans (Free and Pro)

• Bulkio Free: allows unlimited workout logging, template management, and personal-record tracking at no cost. Includes an initial quota of trial messages with the AI Coach.
• Bulkio Pro: a paid subscription tier that unlocks unlimited conversations with the Coach, advanced fatigue analytics, and autoregulated recommendations.

Some features have reasonable usage limits, for example a number of AI Coach messages per day. We may adjust them with reasonable notice.

4. Billing, free trial, renewal and cancellation

• Price and taxes: the price, currency, applicable taxes and billing period (monthly or yearly) are shown before you confirm the payment, in the Stripe checkout, which processes it.
• Free trial: if it is your first subscription you can start with a 7-day free trial; it is offered once per customer. A card is requested to start it and, when the trial ends, the subscription is billed automatically unless you cancel before.
• Automatic renewal: the subscription renews automatically at the end of each period and is charged in advance until you cancel it.
• Cancellation: you can cancel at any time, with no lock-in commitment, from your profile or from the Stripe billing portal. You keep Pro access until the end of the period you have already paid for. We do not refund the unused part of a period that has already started, unless the law requires it.
• Your data: if you move from Pro to Free, your workouts, records and history stay saved and accessible in your account.
• Price changes: if we change the price of Pro, we will tell you before it applies to your next renewal and you will be able to cancel before.

5. Right of withdrawal (EU consumers)

If you are a consumer in the European Union, you have the right to withdraw from the contract within 14 calendar days of entering into it, without giving any reason. To exercise it, write to us at contact@scintly.com stating clearly that you want to withdraw.

If you asked for the service to start during those 14 days (for example, by starting the free trial or by subscribing), you will pay an amount proportionate to what has already been provided until you tell us you withdraw.

6. Health and recommendations

The information, recommendations and AI Coach answers are generated from your data and from general scientific literature. They may contain errors and do not guarantee results. You decide whether to apply them and you train at your own responsibility. Consult a healthcare professional before starting or changing an intense program, a restrictive diet or a competition prep, especially if you have an injury or an illness, or are pregnant.

7. Appropriate use

You agree not to use the service for fraudulent or abusive purposes, not to resell it, not to extract its data by automated means, not to get around the usage limits, and not to deliberately overload the platform's infrastructure through unauthorized automation.

8. Your data and what you share

Your data is yours. You give us the permission needed to store and process it for the sole purpose of providing the service to you, as the Privacy Policy explains. If you share a program or a routine with a link, anyone who has that link can view it: share it only with whom you want. Do not upload photos or data of other people without their permission.

9. Intellectual property

Bulkio's software, exercise catalog, texts and programming engine belong to us or to our licensors. We grant you a personal, non-exclusive, non-transferable license to use them while you have an account.

10. Service availability and changes

We strive to guarantee continuous, smooth availability of Bulkio. However, the service may experience temporary interruptions due to maintenance or causes of force majeure beyond our reasonable control. We may change or withdraw features; if the change significantly affects a paid plan, we will tell you.

11. Suspension and closing of the account

You can delete your account whenever you want from Settings. We may suspend or close an account that breaches these terms or puts the service at risk, telling you when possible.

12. Liability

To the extent the law allows, Bulkio is not liable for injuries, losses or damages arising from the way you use the recommendations, or for interruptions of the service beyond our reasonable control. Nothing here excludes or limits liability that cannot be excluded or limited by law, or your rights as a consumer.

13. Governing law

These terms are governed by the applicable law, without prejudice to the mandatory rights you have as a consumer in your country of residence.

14. Changes to these terms

We may update these terms. If the change is relevant, we will tell you in the app before it applies; if you keep using Bulkio afterwards, you accept it. If you do not agree, you can cancel your subscription and delete your account.
